1. Scope of Application
These Terms and Conditions apply to all contracts between
(hereinafter referred to as the “Mentor”) and her clients (hereinafter referred to as the “Client”) regarding the provision of 1:1 Business English mentoring, regardless of whether the mentoring is conducted online (e.g. via video call) or by telephone.
2. Services
- The Mentor provides individual 1:1 Business English mentoring for professional and business-related contexts.
- The content, scope, duration, and number of mentoring sessions are defined by individual agreement with the Client.
- The mentoring constitutes a service contract under German law. No specific learning outcome, professional success, or particular result is guaranteed.
- The mentoring does not replace legal, tax, or psychological advice.
3. Conclusion of Contract
A contract is concluded by:
- scheduling an appointment via email or calendar tool, or
- written confirmation by the Mentor.
By booking a mentoring session, the Client accepts these Terms and Conditions.
4. Fees, Currency, and Payment Terms
- Fees are based on the individually agreed offer.
- All prices are final prices. Pursuant to § 19 UStG (German Small Business Regulation), no value-added tax (VAT) is charged or stated.
- Unless otherwise agreed, payment is due prior to the start of the mentoring.
- The Mentor is entitled to provide mentoring services only after receipt of payment.
- All payments shall be made in Euro (EUR). Any transaction fees, bank charges, or currency conversion costs (particularly for international transfers from non-EU countries) shall be borne entirely by the Client.
5. Appointments and Cancellations
- Scheduled appointments are binding.
- Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time.
- Cancellations made less than 24 hours before the appointment or failure to attend will be charged in full.
- If an appointment cannot take place due to illness or force majeure on the part of the Mentor, a replacement appointment will be offered.
6. Client’s Obligations to Cooperate
- The Client agrees to attend appointments on time and to ensure the necessary technical requirements (e.g. stable internet connection, camera, microphone).
- The success of the mentoring depends largely on the Client’s active participation.
7. Liability
- The Mentor is liable only for damages caused by intentional or grossly negligent breaches of duty.
- Liability for indirect damages, consequential damages, or lost opportunities is excluded to the extent permitted by law.
- The Mentor assumes no liability for decisions or actions taken by the Client as a result of the mentoring.
8. Right of Withdrawal
Note: The following right of withdrawal applies exclusively to Clients who are consumers within the meaning of § 13 BGB (German Civil Code).
Right of Withdrawal
Consumers have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of conclusion of the contract.
To exercise the right of withdrawal, the Client must inform the Mentor (Claudia Leihkauf, An der Wuhlheide 230, 12459 Berlin, Email: leihkauf@t-online.de) by means of a clear statement (e.g. by email) of their decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient to send the notification before the withdrawal period expires.
Consequences of Withdrawal
If the Client withdraws from this contract, all payments received by the Mentor will be refunded without undue delay and no later than 14 days from the date on which the notice of withdrawal is received.
Expiry of the Right of Withdrawal
The right of withdrawal expires prematurely if:
- the Client expressly requests that the mentoring begins before the withdrawal period has expired, and
- the Client confirms their awareness that they lose their right of withdrawal once the performance of the service has begun.
Such consent may be given in writing or electronically.
9. Confidentiality
- The Mentor undertakes to treat all information disclosed during the mentoring as strictly confidential.
- This does not apply to information that is publicly known or must be disclosed due to legal obligations.
10. Final Provisions
- The law of the Federal Republic of Germany shall apply.
- Place of jurisdiction, insofar as legally permissible, is Berlin, Germany.
- Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
